The expression “Speculation piled on speculation” accurately captures the essence of numerous posts by Elon Musk on his social media platform X.
In this case, Apple’s legal team is utilizing it to respond to X Corp.’s lawsuit against them, which accuses Apple of manipulating App Store charts and showing favoritism towards certain AI applications.
On Tuesday, Apple filed its reply to Musk and his organization, requesting the judge to entirely dismiss the lawsuit.
Musk’s company filed a lawsuit against Apple in August. X Corp. claimed that Apple was “cooperating” with ChatGPT’s creator OpenAI to “sustain their monopolies.” This came after Musk’s public allegations on X against Apple and OpenAI for skewing the App Store against xAI and Grok. Musk asserted that Apple was obstructing his firms from competing fairly.

The lawsuit particularly questioned Apple’s partnership with OpenAI, wherein ChatGPT enhances some Apple Intelligence functionalities. However, Apple’s legal team contends that their arrangement with OpenAI is not “exclusive.”
“The agreement between Apple and OpenAI is explicitly non-exclusive, and it is well known that Apple plans to collaborate with other generative AI chatbots,” proclaimed Apple’s lawyers.
OpenAI’s legal representatives also reacted to Musk’s lawsuit, asserting that he is engaging in “a series of legal warfare” and likewise requested the judge to dismiss the case.
X Corp. contended that Apple’s collaboration with OpenAI mandated Apple to “simultaneously” associate “with every other generative AI chatbot.” Apple’s counselors dismissed this idea, asserting that “antitrust laws do not demand that.”
Musk further claimed in the lawsuit that Apple was skewing App Store rankings in favor of ChatGPT, putting his applications like X and Grok at a disadvantage.
When Musk first alleged that Apple was manipulating the App Store against Grok, X users were swift to point out that many other AI applications have excelled in the App Store rankings. (Musk’s hypothesis was also challenged by Community Notes.) Recently, Gemini has been at the forefront of App Store charts due to the popularity of Nano Banana, an AI image editing tool.
