Warner Bros. Discovery Suit Claims Audacious Larceny by Midjourney


Warner Bros. Discovery is pursuing legal action against Midjourney for copyright infringement, aligning itself with Disney and Universal in the continuing conflict regarding AI’s impact on film and television.

“Midjourney asserts it is not subject to legal regulations. It provides a subscription service, powered by AI technology, created using unauthorized reproductions of Warner Bros. Discovery’s protected works,” the complaint asserts.

The legal action claims that Midjourney engages in theft by freely distributing Warner Bros. Discovery’s intellectual property. An instance referenced is Bugs Bunny, as noted in the complaint submitted to a federal court in California, and reported by The Hollywood Reporter. Other mentioned characters include Superman, Batman, the Flash, Wonder Woman, Scooby-Doo, and the Powerpuff Girls, per the Associated Press.

“The essence of our work lies in crafting narratives and characters to entertain our audiences, bringing to life the vision and enthusiasm of our creative collaborators,” a spokesperson for Warner Bros. Discovery informed The Hollywood Reporter. “Midjourney is intentionally violating copyrighted creations, and we have filed this lawsuit to protect our material, our collaborators, and our investments.”

The Associated Press notes that the lawsuit argues Midjourney creates “consumer confusion regarding what is legal and what is not by misleading its subscribers into thinking that Midjourney’s extensive copying and the multitude of infringing images and videos produced by its service are somehow approved by Warner Bros. Discovery.”

Warner Bros. Discovery is pursuing $150,000 for each work that has been infringed.

This case is among several legal actions targeting AI — Anthropic reached a $15 billion settlement for a copyright case earlier this month, and Disney alongside Comcast’s Universal lodged a complaint in June stating that Midjourney represents a “bottomless pit of plagiarism.”
